1. Definitions and Glossary

• Platform (or Service): Digital system provided by ZapPost AI LLC.
• ZapPost AI LLC: Owner company. EIN: 41-4219308. Headquartered at: 30 N Gould St, Ste R, Sheridan, WY 82801, USA.
• AI Labs: Partners that provide Language Models (OpenAI, Anthropic, Google).
• Payment Gateway: Third-party platforms (Hotmart, Eduzz) that process financial payments.

2. Object and "As-Is" Nature of AI

The Service establishes the temporary licensing of Generative AI tools. The Platform delivers content “as is” (As-Is). AI systems are probabilistic and subject to factual “hallucinations”. The exclusive responsibility for reviewing and curating the generated content lies entirely with the User before publishing.

3. Account, Registration and Age Restriction

Use is restricted to individuals 18 years of age or older. The account requires truthful information. Accounts of minors or fake accounts will be banned without refund.

4. Plans, Payments and Refunds (Gateway)

All billing and financial management is outsourced (Hotmart/Eduzz/Stripe). Tax invoicing follows the base operator. Pursuant to Article 49 of the Brazilian Consumer Defense Code (CDC), the right of withdrawal (7 calendar days) is guaranteed on your first subscription if requested through the gateway. After this legal period, we do not grant refunds on credits.

5. Intellectual Property

All code and designs belong to ZapPost AI LLC. The outputs (generated texts) originating from your use are assigned to you, subject to the copyright limits imposed by international AI legislation (OpenAI).

6. Prohibited Uses

The User undertakes NOT to generate content of hate, explicit violence or illegal/unfounded professional advice (e.g., false promises of cure). Any violation results in immediate banning and reporting to authorities.

7. Limitation of Liability and Indemnities

ZapPost AI LLC, its partners and providers will not be liable for indirect damages, loss of profits or judicial penalties arising from improper publication made by the user based on AI generations. You agree to hold us harmless from third-party complaints (including bodies such as PROCON/CRM).

8. Notifications via WhatsApp

The Platform may trigger transactional notifications and communications via WhatsApp/Email support ([email protected]).

9. Modification of Terms

These Terms may be updated. Continued use denotes full acceptance of the new clauses and generative capabilities of the AI.

10. Applicable Law and Jurisdiction

Governed by Brazilian legislation for residents of the country (safeguarding the CDC) and the Laws of Wyoming – USA, electing the original jurisdiction of the headquarters in the United States for technical omissions.
